Definitions

Buyer: The natural or legal person directly acquiring the Product(s).

Supplier: Roofit Solar Energy or its distributor selling the Product(s) to the Buyer.

Warranty Period: Begins on the date of completion of the installation of the Product(s) but not later than 3 months after delivery of the Product(s) to the Buyer by Roofit Solar Energy, whichever is earlier.

Parties: The Buyer and Roofit Solar Energy jointly.

Qualified installer: An individual or company with documented proof of competence in metal roofing and PV installation or recognized by the Supplier as having the necessary expertise to install the Product(s).

Product(s): Roofit Solar Energy BIPV modules.

Roofit Solar Energy: Roofit Solar Energy OÜ, registry code: 12978418, address Härgmäe 21, 13525 Tallinn, Estonia.

Standard Test Conditions (STC): The determination of the actual yield of solar panels is done according to Standard Test Conditions.: light spectrum of AM1.5, irradiance of 1000 W/m2, and temperature of 25 °C.

Introduction

This Limited Warranty applies to Products delivered to the Buyer on or after August 1, 2024 (Incoterms 2020) and remains valid until a new revision is issued by Roofit Solar Energy.

Geographic Applicability

This Limited Warranty is only applicable to Products installed in following regions: Canada, The United States of America, European Union countries, Albania, Bosnia and Herzegovina, Liechtenstein, North Macedonia, Montenegro, Norway, Serbia, Switzerland and the United Kingdom.
For installations in other countries, the applicability of this Limited Warranty is subject to approval by Roofit Solar Energy upon request.

Product Types Covered

This Limited Warranty applies exclusively to the following module types of Roofit Solar Energy:

  1. NuClick 110/2×12/001, NuClick 165/2×18/001
  2. Velario 115/3×8/001, Velario 145/3×10/001, Velario 175/3×12/001
  3. Roofit 4×12/235W/RR33/B/RC, Roofit 4×8/155W/RR33/B/RC
  4. Roofit 3×8/110W/RR33/B/DS, Roofit 3×10/135W/RR33/B/DS,
  5. Roofit 3×12/160W/RR33/B/DS

General

  1. Roofit Solar Energy provides a Limited Warranty to the Product(s) which is applicable solely to the Buyer.
  2. This Limited Warranty is transferable to any subsequent owner, provided the Product(s) remain installed at their original location without being moved or disassembled after initial installation.
  3. Claims must be received in writing by the Supplier during the Warranty Period, accompanied by the original invoice.
  4. Transport costs for defective Product(s) (for example costs associated with returning Product(s) to the production facility, any measuring facility, or delivery of repaired or replacement Product(s)) are not covered by the Limited Warranty. Return of the Product(s) is permitted only with written consent from Roofit Solar Energy. The warranty does not cover costs related to testing, removal, or installation of the Product(s) or any other expenses incurred by the Buyer.
  5. Visual appearance defects such as scratches, stains, mechanical wear, rust, discoloration, mold, deterioration, and natural oxidation are not covered unless they affect functional capability of Product(s). Claims for breakage are valid only if there was no external influence.
  6. Repair or replacement of Product(s) does not extend the original Warranty Period.

Limited Product Warranty

Roofit Solar Energy guarantees for a period of 10 years (120 months) from the start of the Warranty Period that its Product(s) will be free from material and workmanship defects affecting performance of the Product(s), provided they are installed, used, and maintained according to standard product documentation (such as installation and maintenance manuals, datasheets etc.) which have been provided by Roofit Solar Energy or made available on Roofit Solar Energy’s webpage or given access to by Roofit Solar Energy.

If, in Roofit Solar Energy’s professional judgment, the Product(s) fail to meet this warranty within the Warranty Period, Roofit Solar Energy will, at its discretion:

  1. Repair or replace the defective Product(s).
  2. Offer monetary compensation determined solely by Roofit Solar Energy.

The 10-year Limited Product Warranty does not guarantee specific peak performance.

Limited Peak Performance Warranty

Roofit Solar Energy guarantees for 25 years from the start of the Warranty Period:

  1. For the first year, the actual power output of the Product(s) will be at least 97.5% of the labeled nominal power output.
  2. From the second year, the actual power output of the Product(s) will decrease by no more than 0.73% annually for 24 years. By the end of 25th year, the actual power output will be at least 80% of the labeled nominal power.

This Limited Peak Performance Warranty applies only to performance reductions due to natural aging of glass, cell or embedding film.

If, in Roofit Solar Energy’s professional judgment, the Product(s) fail to meet this warranty within the Warranty Period, Roofit Solar Energy will, at its discretion:

  1. Repair the defective Product(s).
  2. Replace or provide additional Product(s).
  3. Offer monetary compensation determined solely by Roofit Solar Energy.

Actual power output will be verified under STC conditions by Roofit Solar Energy or an authorized third-party testing body. The test equipment tolerances shall be applied to all power measurements, and these are carried out in accordance with IEC60904.

Exclusions and limitations

To maintain warranty validity, the Product(s) must be paired with inverters equipped with Arc Fault Circuit Interrupter (AFCI). Use of inverters without AFCI protection voids this warranty. The warranty does not apply to Product(s) not installed by qualified installers and excludes economic losses, including loss of revenue. It does not cover Product(s) damage or defects caused by:

  1. Negligence during transportation, handling, storage, or use.
  2. Failure to comply with the installation, use, safety and maintenance instructions provided by Roofit Solar Energy (please see the Roofit Solar Energy Safety, Installation, Operation and Maintenance Manuals for specific Product(s)).
  3. Unauthorized repairs or modifications.
  4. Altered or removed product labels, types, or serial numbers.
  5. Improper system design causing constant shading to the Product(s). Excessive snow or wind loads.
  6. Exposure to aggressive substances or chemicals (e.g. direct contact with sea water, salt, salt fog, chemical substances, smoke).
  7. Extreme environmental conditions, lightning strikes.
  8. Installation near flammable gasses.
  9. Events beyond Roofit Solar Energy’s control (e.g., unauthorized and incompatible system components, voltage fluctuations, over voltage, power failures, natural disasters, fire).

In addition, the use of Product(s) in C4 or worse corrosivity category environments (according to ISO 9223, e.g. polluted urban areas, industrial areas, coastal areas, subtropical and tropical zones) and within 10 kilometers of the shoreline is prohibited without prior written consent from Roofit Solar Energy. Exception to this limitation is:

  1. Baltic Sea coastal areas east from Trelleborg in Sweden and east from Stralsund in Germany, where there is no distance limitation from shoreline, provided there is no direct sea water contact.
  2. In Norway, Denmark, and Sweden West coast (west from Trelleborg) coastal areas, the minimum distance from the shoreline must be 300 meters.

Failure to obtain written consent or comply with installation proximity and corrosivity category requirements voids the Limited Warranty.

Claim Process

The Buyer must report any damage to the Product(s) to the Supplier in writing within the corresponding warranty period and within thirty (30) calendar days of discovering the damage. Claims must include:

  1. Full name of the individual making the claim.
  2. Detailed explanation of the claim with supporting documents (e.g., pictures, data).
  3. Proof of purchase of the Product(s).
  4. Product(s) installation address.
  5. Product(s) installation date.
  6. Any additional information required by the Supplier to assess the claim.

Upon receiving a claim, the Supplier may request additional evidence. If the Product(s) needs to be tested by a third party, the institute must be ISO/IEC 17025 accredited, and both parties must agree on it.

A Buyer as a natural person has the right by contacting the respective authorities, to use free of charge, any legal remedies arising from law against the Supplier in the case of non-conformity of the Product(s).

Other provisions

If any provision of this Limited Warranty is ineffective, the remaining provisions retain full effectiveness. The Parties shall replace ineffective provisions with effective ones in line with the Limited Warranty’s objective and purpose.

Estonian law applies to these Limited Warranty conditions. Any disputes shall be exclusively submitted to the competent Estonian institutions.
